Conditions of Hire
Contract of Hire - The hiring contract shall be between the Hirer and the owner of the property for which the booking is made and shall be deemed to be subject to these Conditions of Hire. The Contract of Hire is not effective until the owner has despatched to the Hirer written confirmation of a Booking.
Availability - The booking is made on the understanding that the accommodation will be placed at your disposal on the dates indicated in the booking confirmation. Should this not be possible through events arising totally outside our control (or that of the owners) for example fire, theft or damage and which could force us to cancel your booking, we cannot provide alternative accommodation in which case all monies paid, will be returned to you in full, but you will have no claim against us.
Initial Payment - Bookings will be confirmed upon receipt by the owner of the required deposit payment of 25% of the total due and the signed booking form. The balance then being due 6 weeks prior to the holiday together with £100.00 returnable deposit to cover the cost of any breakages or damage. If the booking is made within six weeks of the holiday commencement date the full accommodation rental will be required, together with £100.00 returnable deposit.
Balance of Payment - The Balance of Hire will be due for payment 6 weeks before the holiday commencement date. The owner reserves the right to cancel a holiday where full payment has not been received less than 14 days before the holiday commencement date and the deposit may be forfeited.
Returnable Deposit - The returnable deposit is due on the balance of payment. The full deposit will then be returned to the Hirer within 28 days of the completion of the Hire period providing no breakages or damage has occurred to either the cottage, its contents or the parking bay area. We will also make a charge if you are late vacating the cottage or you leave the cottage in an unacceptable state of cleanliness
Confirmation of Booking - Once a Confirmation of Booking has been issued by the owner, the Hirer is responsible for the total advertised price of the property and extras as shown on the Confirmation.
Cancellation - In all instances, cancellations must be immediately notified to the owner by telephone. In the case of a cancellation for whatever reason we cannot guarantee to return any monies already paid. We will endeavour to re-let the period concerned and if we are successful we will return any monies paid subject to an administration fee. If we cannot re-let at all, then you will be held responsible for the balance. For this reason we strongly recommend that you take out some form of holiday insurance. We will enclose details of one such company which may be of interest to you when we confirm your booking.
Amenities - The use of accommodation and amenities are entirely at the user's risk and no responsibility can be accepted for injury, and loss or damage to user's or visitor's belongings.
Motor Car and Personal Belongings - Baggage and personal belongings are at the Hirer's risk at all times and no responsibility can be accepted for loss or damage to any car or its contents.
Party Size - In no circumstances may more than the maximum number of persons occupy the property, except by prior written agreement with the owner. The owner reserves the right to refuse admittance if this condition is not observed. In addition the owners reserve the right to refuse or revoke any bookings from parties which may in their opinion (and at their sole discretion) be unsuitable for the property concerned.
Hirer's Responsibilities - The Hirer is responsible for the property and its contents and is expected to take all reasonable care of it. Please ensure that all the equipment is left clean and in good order and should any failure occur it is essential to inform the owner immediately by telephone. If it is found that an excessive amount of cleaning is required to bring the cottage back up to standard then you will be charged accordingly.
Damage - All damage and breakages are the legal responsibilities of the Hirer, and their cost will be deducted from the refundable deposit. If the returnable deposit is insufficient to cover the cost of any damage, then the Hirer will be invoiced accordingly.
Complaints Procedure - If the Hirer is not entirely satisfied with the accommodation offered he should contact the owner immediately by telephone and attempt to resolve the problem. In the event of the owner being unable to resolve any complaint that might arise regarding the standard of the property, the owner reserves the right to refer the complaint to the English Tourist Board for arbitration.
Legal - Any dispute arising between the owner and Hirers, if not mutually resolved shall be referred to a single arbitrator to be agreed, or in default of such agreement, to the President for the time being of the Law Society or Institute of Arbitrators. In either case, such arbitration would be subject to the provisions of the Arbitration Act of 1950 or any statutory modification thereof for the time being in force.
Particulars - The owner takes every care to ensure the accuracy of the property description. All information is given in good faith and believed correct at time of going to print but the owner cannot be held responsible for changes beyond his control, which may be become known after publication of these particulars. Further the owner cannot accept liabilities for happenings outside his reasonable control, such as breakdown of domestic appliances, plumbing, wiring, sudden temporary invasion of pests, damage resulting from exceptional weather conditions or owner's negligence resulting in loss, injury or accident. Should anything occur in this respect, please notify the owner immediately and he will take every possible step to rectify the problem.
